1. Acceptance of Terms

By creating an account on AutoGrow ("the Service," "we," "us," or "our"), accessing the platform, or using any of its features, you ("User," "you") agree to be legally bound by these Terms of Service and Risk Disclosure ("Terms"). If you do not agree to these Terms in their entirety, you must not create an account or use the Service.

You must be at least 18 years of age to use this Service. By accepting these Terms, you represent and warrant that you are 18 or older.

2. Nature of the Service

AutoGrow provides software tools that automate social media interactions — including but not limited to liking posts, following accounts, subscribing to channels, leaving comments, and sending direct messages — on third-party platforms including TikTok, Instagram, YouTube, Facebook, Twitter/X, and Spotify ("Third-Party Platforms").

AutoGrow acts as a software tool only. We do not operate, own, or have any affiliation with any Third-Party Platform. AutoGrow's automation tools access Third-Party Platforms using credentials provided solely by you.

3. Third-Party Platform Risk — Account Suspension & Bans

You expressly acknowledge and agree to the following:

• Automation violates most platform Terms of Service. TikTok, Instagram, YouTube, Facebook, Twitter/X, Spotify, and other social media platforms generally prohibit automated or bot-assisted activity in their Terms of Service and Community Guidelines.
• Your account may be suspended, restricted, shadowbanned, or permanently banned. Third-Party Platforms actively detect and penalize automated activity. Use of AutoGrow may result in temporary or permanent loss of access to your social media account(s).
• AutoGrow cannot guarantee your account will not be banned. While we implement human-like behavior, randomized delays, and conservative daily limits to reduce detection risk, no automation tool can guarantee immunity from platform enforcement.
• You assume full and sole responsibility for any consequences resulting from connecting your social media accounts to AutoGrow, including but not limited to account bans, loss of followers, loss of content, loss of monetization, or any other penalty imposed by a Third-Party Platform.
• Risk increases with usage volume. Higher daily action limits, aggressive targeting, and frequent use significantly increase the risk of detection and account enforcement.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• AutoGrow, its owners, operators, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
• This includes, without limitation: loss of social media accounts, loss of followers or subscribers, loss of business income, loss of advertising revenue, loss of brand value, loss of monetization partnerships, or any other losses — whether foreseeable or not.
• AutoGrow's total cumulative liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount you paid to AutoGrow in the 30 days preceding the event giving rise to the claim.
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

5. No Guarantee of Results

AutoGrow makes no guarantees regarding follower growth, engagement increases, account reach, revenue, or any other outcome. Results vary significantly based on account niche, content quality, platform algorithms, targeting configuration, and many other factors outside our control.

Any growth metrics, estimates, or examples shown on our website or marketing materials are illustrative only and not a guarantee of results.

6. Your Responsibilities

By using AutoGrow, you agree that you are solely responsible for:

• Reviewing and understanding the Terms of Service of each Third-Party Platform before connecting your account.
• Configuring daily action limits responsibly. We strongly recommend keeping limits conservative (under 50 actions/day per platform).
• Ensuring your use of AutoGrow does not violate any applicable laws, including laws regarding spam, unsolicited communications, or unauthorized access.
• Not using AutoGrow to harass, stalk, or target individuals; not using it to spread misinformation, hate speech, or illegal content.
• Keeping your AutoGrow account credentials secure and not sharing access with unauthorized users.
• Any content posted, comments made, or messages sent through automation configured by you.

7. Refund Policy

All payments for AutoGrow subscriptions are non-refundable, including in cases where:

• Your connected social media account is suspended, banned, or otherwise penalized.
• A Third-Party Platform blocks or restricts automated activity.
• You are dissatisfied with growth results.
• You choose to stop using the Service before the end of your billing period.

In exceptional circumstances, refund requests may be reviewed at our sole discretion. Contact support within 7 days of a billing charge to submit a request.

8. Account Termination

We reserve the right to suspend or terminate your AutoGrow account at any time, with or without notice, if we determine that you have violated these Terms, engaged in abusive behavior, or used the Service for illegal purposes. No refunds will be issued upon termination for cause.

9. Indemnification

You agree to indemnify, defend, and hold harmless AutoGrow and its owners, operators, employees, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any third-party rights including Third-Party Platform terms.

10. Intellectual Property

The AutoGrow platform, including its software, design, trademarks, and content, is owned by AutoGrow and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

11. Privacy

By using AutoGrow, you consent to the storage of your social media session cookies in encrypted form on our servers. These cookies are used solely to operate the automation you configure. We do not sell, share, or transfer your credentials or personal data to third parties. You may delete your account and all associated data at any time by contacting support.

12. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after such notice constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction. Any disputes arising from these Terms shall be resolved through binding arbitration rather than in court, except where prohibited by law.
